World’s two largest Smartphone selling
companies: Apple and Samsung are on the battlefield for Patent Right. The verdict (Friday, 9th August, 2013)
International Trade Commission (ITC) has banned the unauthorized patent used on
Samsung mobile and Tablets. The next step, Samsung can appeal for dismiss this
verdict through using veto power of President Barack Obama. Now, the ball has
gone to the coat of President Obama and if this verdict dismissed then Samsung
can go to court for final verdict. According to ITC, Samsung can sell and
import its unauthorized mobile sets and tablets till 60 days in US Market. Within this period (60 days), President can dismiss
the verdict.
This
verdict is the great succeed of Apple against patent right. South Korean
Company Samsung has been using Apple’s patent right unauthorized ways and using
Apple’s technology on Samsung Smartphone and tablets. Samsung is the world’s largest
and fastest Smartphone selling company and its market shares has been
increasing rapidly. Due to the market expansion of Samsung, the US base Company
Apple has been aggressively stands for protect its intellectual Property Right
(IPR) and confront over its rival Samsung. Samsung blamed that it was not blond
verdict and Samsung becoming so unhappy because of unexpected verdict of ITC.
Apple’s law adviser William Ley explained that, this verdict was favor of Apple and Samsung
has got this painful decision due to violating its patent right on the
unauthorized ways. Apple blamed that Samsung infringed different Apple’s
patent. This is the 3 years (2010 -2013) long patent war and both companies
invested lots of amount to wins this race. Apple said “this verdict was not
only victory but also was fair dealing.”
The market
of Smartphone has been rapidly growing and these two leading companies are
aggressively taking marketplaces. Victories of Apple, commanding world-wide
market place of Smartphone sales and Samsung will knock the door of court.
The
spokeswomen of Apple – Kristin Hugust said “Apple is really happy and confident
that it will definitely protects its patent right”. It means US import ban for
Samsung. Apple planning to release new iPhone 6and
on the other hand Samsung is also going to release new Smartphone Samsung
Galaxy S5 in April, 2014. Though, this dispute may influence the
Samsung’s sales volume and Apple can get some relief. There is no doubt that
Samsung is world’s largest Smartphone
seller.
